Terms of Use

These conditions govern access to California Criminal History. Reading a guide, opening a page, or using a search feature signifies acceptance of them. Anyone who does not agree should discontinue use of the website.

NO FCRA USE. California Criminal History is privately operated and has no government affiliation. This site and its advertising partners do not provide services for credit, employment, insurance, tenant, or other decisions regulated by the Fair Credit Reporting Act. The site is a California records reference, not a private investigation firm or consumer reporting agency.

1. What This Website Is

This private reference site is independent of every government office. It neither stores official criminal records nor retrieves records, performs official checks, or submits filings.

Its guides point to CA DOJ, the California Department of Corrections and Rehabilitation, the California Megan's Law Website, California courts, and local sources in all 58 counties. The California Public Records Act, Government Code §7920.000 et seq., does not make confidential CA DOJ summary criminal history public under Penal Code §11105. Some pages also connect visitors with independently operated search tools.

2. Rules for Using This Site

You agree that you will not:

  • Break any federal, state, or local law while using this site
  • Use information you find here to stalk, harass, or threaten anyone
  • Base hiring, housing, lending, or insurance decisions on content from this site
  • Try to break into our systems or gain access you are not supposed to have
  • Run bots, scrapers, or automated tools against our pages
  • Do anything that slows the site down or blocks other people from using it

3. No Harassment, Stalking, or Discrimination

Information found here or through a linked tool may not be used to threaten, intimidate, stalk, harass, or discriminate against anyone. California Penal Code section 290.46 imposes special restrictions and potential penalties for misuse of California Megan's Law Website information. The registry supports personal and community safety, not vigilantism or prohibited decision-making.

4. We Are Not a Consumer Reporting Agency

We are not a consumer reporting agency under the FCRA. We do not generate background checks, credit reports, or consumer reports of any kind. Neither we nor our advertising partners provide services built for screening job applicants, reviewing rental applications, calculating insurance rates, or judging creditworthiness. You agree not to use data from this site or any linked tool to:

  • Decide whether to hire or fire someone
  • Screen potential renters or housing applicants
  • Judge creditworthiness or set insurance premiums
  • Determine who qualifies for licenses, permits, or government programs
  • Do anything else that falls under FCRA rules

Any check for an FCRA-regulated purpose must come from a properly authorized, FCRA-compliant provider or the applicable official channel.

5. No Legal Advice

The guides provide general California records information, not legal advice. Only a licensed California attorney can advise how a charge, warrant, conviction, dismissal, or sealing rule affects a specific matter.

6. No Warranties

Everything on this site is provided "as is." We do not guarantee that:

  • The information here is accurate, complete, or current at any given time
  • The site will stay up and running without interruptions
  • Our pages are free of errors, bugs, or security holes
  • Results from our partner search tools will be thorough or accurate

Criminal records change all the time - charges are filed, dismissed, sealed, and expunged. We try to keep up, but gaps are unavoidable. Nothing on this site should be treated as an official statement from a court, sheriff, or government agency.

7. Third-Party Services and Links

We link to state agency pages, court portals, county sheriff and clerk sites, legal aid organizations, and outside search services across this site. Clicking one of those links moves you off our platform and onto one we have no control over. We are not responsible for their content, how they handle data, what they charge, or whether their site stays online. Check their terms before using them.

8. Intellectual Property

California Criminal History and its content partners own the site's text, graphics, logos, and code. Copying, distributing, modifying, or creating derivative material requires prior written permission.

9. Limits on Our Liability

To the fullest extent the law allows, we are not liable for damages that come from using this site - including decisions made based on information found here or through any linked service.

10. Indemnification

You agree to hold us harmless from any claim, legal action, or demand that stems from how you used this site or from breaking these terms. That includes covering our legal fees and related costs.

11. Governing Law

California law governs these terms, including applicable California consumer-protection requirements. Any dispute concerning site use must be brought in a court located in California.

12. Changes to These Terms

We can update these terms whenever we see fit. New terms go into effect the moment they appear on this page.

13. Cutting Off Access

We can limit or block your access to this site at any time, for any reason, with no warning.

14. Severability

If a court rules that any part of these terms is invalid or unenforceable, the rest stand. The problem section gets adjusted only as much as needed to make it work.
